Branciforte Fire Protection District Appropriations Limit

BRANCIFORTE FIRE PROTECTION DISTRICT
CHANGE OF APPROPRIATION LIMIT MEASURE M
Full text of ORDINANCE NO. 98-1

The People residing in the Branciforte Fire Protection District of the County of Santa Cruz, State of California, do ordain as follows:

Section I

Necessity The Board of Directors of the Branciforte Fire Protection District deem and determine it necessary to hereby propose the Branciforte Fire Protection District be authorized to raise its limits of appropriations pursuant to Article XIII B of the Constitution of the State of California.

Section II

Change of Appropriations Limit Upon Voter Approval That pursuant to Article XIII B of the Constitution of the State of California a general election be held in the Branciforte Fire Protection District on the 3rd day of November 1998, for the purpose of submitting to the qualified voters of said District a Proposition which, if approved by a majority of the voters voting at said election, will authorize and allow the District to raise its limits of appropriations.

Section III

Change of Appropriations Limit The appropriations limit for the Branciforte Fire Protection District is changed pursuant to Article XIII B of the Constitution of the State of California to an amount the total of which will equal the combined total of all of the following:

  1. The amount of all ad valorem taxes on property to which the District is entitled as limited by Article XIII A of the Constitution of the State of California and any legislation supplemental thereto.
  2. The amount of property taxes or other funds allocated or apportioned to the District pursuant to any other provisions of California law, local law, or judgement.
  3. The amount of the proceeds from the special taxes which were authorized by more than two-thirds of the District Voters on November 5, 1996.
  4. Any interest received by the District and
  5. Any subvention or other aid received from the State of California.

If said changes are approved by the voters, it shall be for each of the fiscal years retroactively from 1997 and shall remain in effect for a period of four years from and after the date of this election unless changed by the voters at a subsequent election or elections.

Section IV

Priorities To the extent that additional revenues are received by the District as a result of the adoption of this ordinance, the following programs shall be given priority:

  1. Continued funding of existing operations including training.
  2. Operation and maintenance of the Branciforte Fire Protection District Stations.
  3. Purchase of new equipment required by law.

Because the exact nature of additional tax revenues cannot be predicted and major unforeseen events can force a reordering of priorities, the Board of Directors shall have final responsibility for determining the time, financing and extent of expenditures pursuant to the established priorities.

Section V

Saving Clause The intent of this initiative is to comply with California Constitution Article XIII B. If any section, part, clause, form, word or phrase hereof is for any reason held to be invalid, the remaining provisions of this act shall remain in full force and effect and shall be interpreted to serve the intent of this ballot proposition.
